USCIS Returns Unselected Cap-Subject H-1B Petitions for FY2017

The United States Citizenship and Immigration Services (USCIS) announced recently that it has now returned all fiscal year 2017 H-1B cap-subject petitions which were not previously selected in the lottery. (Petitions selected in the random selection process were previously announced as completed on May 2, 2016.)

What does this mean?

This latest news means that anyone who submitted the petition for the 2017 fiscal year should receive a receipt notice or returned petition by July 22, 2016.

What if my H-1B is rejected?

Shane & Shane advises those receiving returned petitions that there may be alternatives to the H-1B visa that are not subjected to a cap. These can include the O, E and/or L visas.

Our expert Board Certified attorneys evaluate every single case very carefully during a comprehensive consultation in order to provide you with any and all alternatives to the H-1B visa. The same level of thought and consideration is also taken for other visa types and each individual’s immigration situation.

If your H-1B was not selected or you have questions about your options, we encourage you to contact Shane & Shane today to discuss alternatives.
